INFORMATION REGARDING MINORS



CURFEW (Parish Ordinance 5-19.3)

UNDER 17: 10:00 p.m. Monday-Thursday and 11:00 p.m. Friday-Sunday

Sixteen and younger attending an organized adult supervised function is allowed (1) one extra hour grace period to return home or to a place agreed upon by the minor's parents, legal guardian, or person having the care, custody, and control of the minor.

TOBACCO (LRS 14:91.8)
It is unlawful for any person under the age of 18 to possess any tobacco product except when accompanied by a parent, spouse, or legal guardian 21 years of age or older.

ALCOHOL (LRS 14:93.10)
It is unlawful for any person under the age of 21 to publicly possess or consume any alcoholic beverage except when the person under 21 is ACCOMPANIED by a parent, spouse, or legal guardian 21 years of age or older. It is unlawful for anyone under the age of 21 to purchase alcoholic beverage (LRS 14:93.13).

Public possession or consumption does not include:
  1. For an established religious purpose;
  2. When a person under 21 years of age is accompanied by a parent, spouse, or legal guardian 21 years of age or older;
  3. For medical purposes; and
  4. In a private residence

CONTRIBUTING TO CHILD'S DELIQUENCY (LRS 14:92.1)
It is unlawful for the parent or parents, legal guardian, or any person having custody of a juvenile, or any other person or persons who shall by any act encourage, cause, or contribute to the dependency or delinquency of such juvenile, or who acts in conjunction with such juvenile in the acts which cause such juvenile child to be delinquent. Delinquency means any act which tends to debase or injure the morals, health, or welfare of a juvenile which may include the juvenile drinking alcoholic beverages. For this statute "juvenile" refers to any child under the age of 17. Lack of knowledge of the juvenile's age is no defense.

DRIVING UNDER THE INFLUENCE (LRS 14:98.1)
It is unlawful for a person under the acle of 21 to drive a vehicle with a blood alcohol concentration of 0.02. It is unlawful for a person 21 years of acie or older to drive a vehicle with a blood alcohol concentration of 0.1 (LRS 14:98) (in 2003, the blood alcohol level lowers to .08). In both cases, driving privileges may be suspended (LRS 32:661).

MONETARY AWARD (CC ART 2315.2)
A monetary award (punishment damages) may be awarded to the victim of a driver whose intoxication was a cause of an accident. Automobile liability insurance policies usually do not provide coverage for such damages.

FAKE ID's (LRS 32:414.1)
It is unlawful for any person:
  1. To display or permit to be displayed or have in his possession any invalid driver's license which has been intentionally altered.
  2. To lend his driver's license to any person or knowingly permit the use thereof.
  3. To display or represent as one's own any driver's license not issued to him.

LEGAL GUARDIAN (Ch. C. ART 116 (12.1)(a)&(b) )
Legal Guardian is the caretaker of a child until the child reaches the age of majority (18 years of age). The Legal Guardian usually has the right and the duty to:
  1. Have the physical custody of the child and to determine where the child resides;
  2. Protect, train, and discipline the child;
  3. Consent to major medical, psychiatric, and surgical treatment;
  4. Provide the child with food, shelter, education, and ordinary medical care;
  5. Consent to marriage, to enlist in the armed forces of the United States; and
  6. Represent the minor in legal actions.
